The Judicial Collegium for Criminal Cases of the Supreme Court of the Russian Federation rejected the cassation appeal against the verdict of the Moscow Regional Court to doctors Elena Belaya And Elina Sushkevich. The defense’s arguments were left unsatisfied, the lawyer told MV Kamil Babasov.
The case was considered on December 5. Sushkevich and Belaya attended the meeting via videoconference. Belaya complained to the judge that violence was being used against her in the colony, Babasov said.
“We plan to continue to insist that communication between the judge and the jury during the trial is unacceptable. We want to ask these questions in the Constitutional Court. But first, let’s see what the Supreme Court writes in its ruling,” the lawyer added.
In the summer of 2019, resuscitator Elina Sushkevich was charged with committing the murder of a child, and Elena Belaya was charged with organizing it. According to investigators, in November 2018, acting The head physician of maternity hospital No. 4, Belaya, gave instructions to kill the premature baby, and in the documents to record him as stillborn, so as not to spoil the infant mortality statistics. The investigation believed that Sushkevich administered magnesium sulfate to the newborn, after which he died.
In December 2020, the jury acquitted Belaya and Sushkevich; the prosecutor’s office appealed this decision. The First Court of Appeal of General Jurisdiction overturned the acquittal and sent the case for a new trial to the Moscow Regional Court with the reasoning that the defense had doubts about the competence of the experts and emotional impact on the jury. On September 6, 2022, the Moscow Regional Court sentenced Sushkevich and Belaya, based on the guilty verdict of the jury. They were sentenced to 9 and 9.5 years in a general regime colony, respectively. Both were deprived of the right to engage in professional activities for three years.
Defense attorneys appealed the verdict. However, in April 2023, the First General Court of Appeal declared it legal and upheld it. During the appeal, four jurors who participated in the trial in the Moscow Regional Court spoke about the pressure the judge put on them.
All this time, both doctors continue to insist on their innocence.
