Chelyabinsk OFAS proved a cartel conspiracy in the supply of medical equipment worth 500 million rubles

The Chelyabinsk OFAS filed a case of cartel conspiracy against 17 companies in the purchase of medical equipment. The main customer was the regional Ministry of Health.

The Antimonopoly Service of the Chelyabinsk Region identified a cartel at auctions for the supply of medical equipment and medical products (in particular endoscopes, X-ray systems, ventilators, etc.) for a total amount of over 500 million rubles. In the majority of purchases (46 out of 49), the customer was the regional Ministry of Health.

The materials of the antimonopoly case were transferred to law enforcement agencies to consider the presence of signs of a crime under Article 178 of the Criminal Code of the Russian Federation (restriction of competition). The suspects include 17 companies from Chelyabinsk, Magnitogorsk, Kurgan, Orenburg, Yekaterinburg, Moscow, St. Petersburg, the republics of Bashkortostan and Udmurtia. In 2020-2021, these suppliers went to tender in an organized manner and used “carousel waltz” and “sole supplier” behavioral models for concluding contracts at maximum prices.

“Waltz-Carousel” is a scheme in which participants distribute tenders in advance, at least two business entities submit bids in order to ensure imaginary competition, and in the absence of competitors, one of the cartel participants makes the minimum price offer. “Sole supplier” – in this scheme, participants pre-determine the company that will be the first to submit a bid or make the first price offer and subsequently become the winner.

In most procurements, cartel participants reduced the initial price of contracts by 2-4%.

Among the participants of the identified cartel CJSC “Medservice-Region”, LLC “Sib-APN”, LLC “Gazneftesnab”, LLC “Ural Company”, LLC MC “Nika”, LLC “ORBiMED”, LLC “TransMed”, LLC “Medproject-Zauralye”, LLC ” FortMedTech”, LLC “MLT Service”, LLC “Rome 2020”, LLC “Region-Service”, LLC “Medical Technologies”, LLC “MTM”, LLC “MS”, LLC “IzhMedTech”, LLC “Medfarmservice”.

In March 2023, as MV wrote, the Chelyabinsk OFAS suspected 19 companies of collusion for a total amount of almost 740 million rubles. For now Medresurs LLC and Ural Med Reserve LLC were excluded from the list of cartel participants.
